PART 1: TERMS & CONDITIONS

1. DEFINITIONS 1.1 “The Company” means Viscale Ltd.

1.2 “The AI Assets” refers to imagery generated via the automated biometric mapping portal.

1.3 “The Photographs” refers to traditional imagery from in-person sessions.

2. TRADITIONAL PHOTOGRAPHY 2.1 Bookings: A non-refundable booking fee is required. 48 hours' notice is required for rescheduling.

3. AUTOMATED AI SERVICES 3.1 Biometric Waiver: The Client acknowledges that AI Assets are synthetic representations. Minor variations in facial features or textures ("artifacts") are an inherent part of the technology.

3.2 Source Quality: Output quality depends on the Client following the "Image Upload Guidelines."

4. INTELLECTUAL PROPERTY 4.1 Ownership: Viscale Ltd retains the copyright of all Photographs and AI Assets.

4.2 License: Upon full payment, the Client receives a perpetual, worldwide license for professional and promotional use.

5. PAYMENT & REFUNDS 5.1 Final Sale: Due to immediate computational costs, all sales for automated AI services are final. No refunds are issued for "change of mind" or failure to follow instructions.

6. LIMITATION OF LIABILITY 6.1 The Company’s total liability for any claim shall not exceed the Fee paid by the Client for the specific Commission.

7. INDEMNITY (YOUR PROTECTION) 7.1 Source Material: The Client warrants that they own the copyright or have obtained all necessary permissions for any images uploaded to the portal. The Client agrees to fully indemnify and hold harmless Viscale Ltd against all expenses, damages, claims, and legal costs arising from any third-party claim of intellectual property infringement related to the source images provided.

7.2 Usage: The Client agrees to indemnify Viscale Ltd against any claims, losses, or legal actions resulting from the Client’s specific use of the AI Assets, including but not limited to any use that is defamatory, illegal, or in breach of third-party platform terms (e.g., LinkedIn).

PART 2: PRIVACY POLICY (UK GDPR)

1. DATA CONTROLLER Viscale Ltd is the Data Controller. We process your data under the UK Data Protection Act 2018.

2. BIOMETRIC PROCESSING 2.1 Consent: By uploading photos, you provide explicit consent for the processing of your facial biometric data strictly for generating your assets.

2.2 No Training: Your images are never used to train public AI models.

3. TECHNOLOGY PARTNERS We use secure, industry-standard partners for Payment Processing, Workflow Automation, Private AI Computing, and Encrypted Cloud Storage.

4. RETENTION Source photos and biometric data are purged within 30 days. Final assets are purged after 3 months.

5. YOUR RIGHTS You have the right to access or request immediate erasure of your data by emailing studio@viscale.ai.
